These Creator Incentive Program Terms and Conditions (the "Incentive Terms") are updated and effective as of October 25, 2024. Along with BLCKTEC’s general Terms of Service, Privacy Policy, and Affiliate Marketing Guidelines (collectively, the "Governing Documents"), they form a binding agreement between you and BLCKTEC.
By participating in the BLCKTEC Creator Incentive Program (the "Program"), you agree to abide by these Incentive Terms and the Governing Documents. If any part of these Incentive Terms conflicts with the Governing Documents, the Incentive Terms will take precedence.
Your compliance with these Incentive Terms is necessary for participation and receipt of any rewards ("Awards"). Participation in the Program constitutes your agreement to the terms, as they may be updated from time to time.

The Program runs from October 25, 2024, through December 31, 2024 (PST). Awards will be determined based on Gross Merchandise Value ("GMV") generated during this period. BLCKTEC’s clock is the official clock for determining Program deadlines.
Affiliates must generate gross merchandise value (“GMV”) from Product sales via your Affiliate Content on the BLCKTEC Shop on TikTok Shop (and only sales on the BLCKTEC Shop on TikTok Shop will be counted) during the Program Period in accordance with usual and customary Affiliate Services in order to be eligible to win an Award.
Affiliates must sign up for the Program by submitting a completed registration form found here: Registration Form in order to be eligible to win an Award. GMV generated outside of the Program Period, or outside the TikTok Shop platform or the BLCKTEC TikTok Shop, is not eligible.
To participate, generate GMV from BLCKTEC product sales via your TikTok Shop content. GMV must be generated on a single TikTok account. For every $1,000 GMV generated, you will earn 1 point ("Point"), which can be redeemed for rewards.
Only sales made on the BLCKTEC TikTok Shop during the Program Period will count. GMV generated before October 25, 2024, or outside the TikTok Shop platform will not be eligible.
Affiliates are responsible for keeping track of their GMV achieved during the Program Period. Once you have accumulated Points based on your GMV, take the following actions to make a claim for a reward (“Award Claim”) and be verified:
All Award Claims must be initiated within thirty (30) days of the end date of the Program Period. Proof of email is not proof of receipt by BLCKTEC. The decisions of BLCKTEC will be final in all matters relating to this Incentive Program, including but not limited to verification of Promotion Period sales figures. BLCKTEC reserves the right to audit any Award Claim to verify accuracy/validity. Award Claims must include all requested information to verify GMV per the existing BLCKTEC Affiliate Terms and Conditions. Award Claims without sufficient information, as determined in BLCKTEC’s sole discretion, may not be processed as eligible for the Creator Incentive Program.
FOR CLARITY, Affiliates are responsible for submitting Award Claims. NO AWARD CLAIMS RECEIVED AFTER THIRTY (30) DAYS AFTER THE END DATE OF THE PROGRAM PERIOD WILL BE ACCEPTED.
Following verification of your Award Claim, you will be notified by email and may be required to complete, execute, and return an Affidavit of Eligibility and, except where prohibited by law, a Liability and Publicity Release and other documents as reasonably requested by BLCKTEC within ten (10) days of such request/notification (“Winner Documentation”). Failure of a winner to comply with this requirement may result in disqualification and Award forfeiture, in BLCKTEC’s sole discretion. If a winner is otherwise eligible under these Incentive Terms but is deemed a minor in their state of primary residence (“Minor”), the Award will be awarded in the name of the winner's parent or legal guardian, who will be required to execute and return the Winner Documentation on the Minor’s behalf, as applicable.
Affiliates may redeem rewards based on the number of Points accumulated at the end of the Program Period. Every $1,000 GMV generated equals 1 point, which can be used to claim rewards or cash equivalents. The Points system allows Affiliates to choose their desired reward(s) based on their total Points.
There is no limit to the number of rewards you can claim, as long as you have the required Points balance. Once Points are redeemed for a reward, they will be deducted from your balance.
Please note that the availability of any prize is not guaranteed. In the event a prize item is unavailable, BLCKTEC will reward you with the cash equivalent based on the Approximate Retail Value (ARV) of the prize.
You can redeem Points for any reward from the available catalog, and each redemption will result in a deduction of the corresponding Points from your balance. You are free to choose rewards based on the number of Points you’ve accumulated during the Program Period.

BLCKTEC is not liable for any damages, losses, or injuries resulting from participation in the Program or the acceptance of any reward. By participating, you release BLCKTEC from all liability related to the Program and any prize fulfillment.
All disputes arising from the Program will be resolved through binding arbitration under the rules of the American Arbitration Association, in the State of California. Participants waive their right to a jury trial or class-action lawsuit.
Any rewards exceeding a value of $600 are subject to federal, state, and local taxes. Creators are responsible for reporting and paying applicable taxes. BLCKTEC will issue a 1099 form for rewards valued over this threshold.
BLCKTEC reserves the right to modify or terminate the Creator Incentive Program at any time. Any changes will be communicated through official company channels, and continued participation in the Program following these changes will constitute acceptance of the new terms.
Except where prohibited by law, acceptance of any Award constitutes the winner’s consent to BLCKTEC and its designees for the use of the winner's name, Award won, hometown, likeness, TikTok handle, photograph, and statements for purposes of advertising, promotion, and publicity (including online posting) in any and all media now or hereafter known, throughout the world, in perpetuity, without additional compensation, notification, review, approval, or permission.
You agree that BLCKTEC is not responsible for and you agree to release and hold harmless BLCKTEC and TikTok from any and all liability in connection with the following:
This release includes, without limitation, any claim for personal injury, property loss, or damage, or death arising in connection with the Program, as well as claims based on publicity rights, defamation, and/or other proprietary or privacy rights.
By participating in the Program, you acknowledge and agree that BLCKTEC reserves the right, in its sole discretion, to modify, suspend, or cancel the Program at any time for any reason. Any such action will be communicated through official company channels. Should the Program be terminated before the stated end date, BLCKTEC reserves the right to fulfill Awards to eligible Creators who have submitted verified Award Claims prior to the termination date. BLCKTEC reserves the right to disqualify any Creator found to have tampered with or abused any aspect of the Program. Any attempt to deliberately undermine the legitimate operation of the Program may be a violation of criminal and civil laws, and BLCKTEC reserves the right to seek damages from any such person to the fullest extent permitted by law.
In the event of any discrepancy between other Program-related materials and these Incentive Terms, these Incentive Terms shall prevail and govern.

The Terms and Conditions of the BLCKTEC Creator Incentive Program are subject to change at any time without prior notice. It is the participant’s responsibility to review these terms regularly. Continued participation in the Program following any updates will constitute acceptance of the revised Terms and Conditions.
